Terms of Service for Plugsera Reviews

1. Service Description

Plugsera Reviews ("the App," "Service," or "we") is a software application developed for merchants operating on the Shopify ecommerce platform. The App provides tools to collect customer feedback, manage customer product reviews and ratings, moderate submissions, upload review photos, and display social proof badges and widgets on Shopify storefronts using native Shopify Metaobjects and Theme App Extensions.

2. Agreement to Terms

By installing, accessing, or using Plugsera Reviews from the Shopify App Store, you ("Merchant" or "You") agree to be legally bound by these Terms of Service. If you do not agree to these terms, you must uninstall and discontinue using the App.

3. Merchant Responsibilities

As a Merchant using the App, you agree that you are solely responsible for:

• Maintaining the security and confidentiality of your Shopify store administrative credentials.
• Ensuring that your collection, moderation, and publication of customer reviews comply with all applicable local, national, and international laws, regulations, and consumer protection directives.
• Providing clear notices in your storefront privacy policy regarding how customer reviews, ratings, author names, and submitted media are gathered and displayed.

4. Review and Content Authenticity

The Merchant retains responsibility for all reviews, ratings, comments, and merchant responses displayed on their storefront. You agree not to:

• Submit, generate, or publish fraudulent, fake, or misleading customer reviews.
• Incentivize or compensate customers for reviews without clear, conspicuous disclosure in accordance with applicable Federal Trade Commission (FTC) guidelines or relevant consumer law.
• Deceptively suppress or selectively filter out genuine negative reviews solely because of unfavorable ratings.

5. Customer-Submitted Content

Reviews, comments, and ratings submitted by your storefront customers remain the property or responsibility of the individual submitting them. By submitting content through the App, customers grant the Merchant a non-exclusive license to display the content on the Merchant's storefront. The Merchant is responsible for addressing any customer disputes, copyright notices, or takedown requests regarding customer-submitted content.

6. Photo and Media Handling

When customers upload photos with their reviews, these images are staged and stored directly in the Merchant's Shopify Files storage and delivered via Shopify's Content Delivery Network (CDN). Merchants are responsible for monitoring and moderating customer-submitted photos. Uploading or displaying content that is defamatory, obscene, pornographic, infringing, hateful, or otherwise unlawful is strictly prohibited.

7. Data Storage & Privacy Alignment

In strict alignment with our Privacy Policy:

• Shopify Metaobjects Storage: Review data is stored directly in the Merchant's Shopify Metaobjects (type: plugsera_review). Plugsera Reviews does not maintain a separate external customer review database.
• Scope of Processing: Customer personal data is processed solely when required for review functionality, verified buyer badge verification, and related Shopify workflows.
• No Selling of Data: Customer data is never sold, leased, or used for unrelated advertising or behavioral profiling.
• Shopify Compliance Webhooks: Mandatory compliance webhooks (customers/data_request, customers/redact, and shop/redact) are supported to enforce merchant and customer privacy rights.
• Data Retention: Review data remains in your store's Metaobjects under your ownership and direct control until deleted by you. App session tokens on the app server are erased upon app uninstallation or shop redaction.

8. Plans and Shopify Managed Billing

Plugsera Reviews offers a Free tier and paid subscription tiers (including Early Bird Pro at $5.00/month and Standard Pro at $10.00/month):

• Shopify Managed Billing: All billing, invoicing, and subscription renewals are handled exclusively through the official Shopify Billing API (Recurring Application Charges).
• Monthly Invoice: Charges appear on your standard monthly Shopify subscription bill. Plugsera Reviews never requests, processes, or stores your credit card numbers or banking information directly.

9. Free and Paid Plan Limitations

• Free Plan: Includes management of up to 200 customer reviews, standard storefront badge and widget layouts, and automated star ratings. Storefront widgets may include subtle "Powered by Plugsera" attribution.
• Pro Plans: Offer unlimited review capacity, custom star colors, removal of "Powered by Plugsera" branding, priority review request settings, and advanced moderation capabilities.

10. Cancellation and Downgrades

Merchants may downgrade to the Free tier or cancel their subscription at any time directly through the app's in-app billing dashboard. You may also cancel immediately by uninstalling the application from your Shopify Admin. Subscription cancellations take effect according to Shopify's standard recurring billing rules. Because reviews reside in Shopify Metaobjects, your customer reviews remain in your Shopify store even after uninstallation.

11. Acceptable Use Policy

You agree not to use the App to:

• Violate any applicable laws, regulations, or Shopify's Acceptable Use Policy.
• Introduce viruses, malware, trojans, or harmful code into the App or Shopify platform.
• Reverse engineer, decompile, or attempt to extract the source code of the App.
• Circumvent plan limits, authentication mechanisms, or security controls.

12. Intellectual Property

Plugsera Reviews, including its software code, designs, logos, and documentation, is the exclusive intellectual property of Plugsera Reviews and its licensors. You are granted a limited, revocable, non-exclusive, non-transferable license to use the App on your Shopify store during your active installation. Merchants retain 100% ownership over their own store brand, products, customer reviews, and media.

13. Third-Party Services and Shopify Platform

The App relies on and integrates with Shopify's platform, APIs, Metaobjects, and CDN. We clearly distinguish between Plugsera Reviews' application processing and Shopify's underlying platform and infrastructure. We are not responsible for delays, service interruptions, performance issues, or platform deprecations caused by Shopify or external network providers.

14. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE SERVICE.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PLUGSERA REVIEWS, ITS OPERATORS, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OR INABILITY TO USE THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY EXCEED THE TOTAL FEES PAID BY YOU FOR THE APP IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.

We reserve the right to modify or update these Terms of Service at any time. Material changes will be communicated by updating this document or via in-app notifications. Continued use of the App following any update constitutes your acceptance of the revised Terms.
